a letter sent to Borough Manager Tom Fountaine last week, Columbia Gas threatened possible legal action in the dispute over a high pressure gas pipeline.

The letter also asserts the denial is void for vagueness, and violates the fifth and fourteenth amendments of the constitution.
Borough council released its own statement indicating it will review the permit denial with its lawyer. It goes on to say, "Given the potential threat of future litigation, the Council and staff will provide no further comment on this matter."

That sparked an outcry from State College residents. Opponents worried the pipeline might be dangerous and could hurt property values. As a result, borough council passed a resolution denying a permit to build the pipeline.
Penn State has asked Columbia Gas to consider an alternative on campus route for the pipeline and the gas company is now working on that proposal.

"Council and staff understand that the public is extremely concerned about the natural gas pipeline. Concerns about safety and the need for transparency in decisions that affect the health, safety and welfare of the community have been heard by Council, and the Borough is fully committed to defending its position in not permitting this pipeline installation through residential neighborhoods."
The pipeline is needed to convert Penn State's power plant from coal to natural gas.

Under the original plan, that pipeline would have been routed through several State College Streets including, Bellaire Ave., University Dr., Prospect Ave., and Burrowes St.
Columbia outlines a number of issues that it claims makes the permit denial illegal. It says routing gas lines through residential neighborhoods is not prohibited under any federal, state or local law.
Penn State spokesperson Lisa Powers issued this statement, "We have asked Columbia to investigate on campus routes and we will put the line on campus if it's practical. Columbia is exploring this aspect."
Columbia suggests a two step process. First, Columbia wants to withdraw its original permit request without prejudice. Second, it wants the council to pass a resolution rescinding the denial, and agreeing not to use the original denial in any future request for a permit.
