Under Section 12: Resignation of Mr. O'Keefe's contract, if he resigns his position there is no compensation other than any vacation and sick days that might have accrued. If, however, under Section 9: Termination, if he resigns following an offer to accept resignation, he is entitled to 12 months of salary. While the Town Council majority has kept me in the dark and withheld information, what I do know is that the actions taken by the East Hampton Town Council majority are indefensible. I was excluded from private discussions regarding both the Town Manager's "resignation" and the terms of his "pay off."

The mishandling of the sexual harassment complaints and the illegal restructuring of the EHPD has cost the town dearly. Public trust in town government has been shattered. Employee morale and productivity are at an all time low. Public safety has been compromised.

I am releasing this document to the public, as I believe it is their right to have this information. I have grave concerns about what was signed away in this agreement. Entering into this agreement so quickly and rubberstamping it without proper discussion was grossly premature and unfair to East Hampton's taxpayers. While I forced the Council majority to release the cost of the severance package, they refused to release the terms of the agreement. I disagreed. I said it was a public document, and that without a court order stating otherwise, it is required to be released. Attorney Sommaruga, who appeared to be representing both the Town and Mr. O'Keefe, disagreed. At the time, I respected Executive Session privilege and did not comment.
Today I called the FOI Commission and was told that I was correct; the severance package is a public document and it can be released. In fact Sec. 1 214a of the FOI Act specifically states that the disclosure of a public agency termination, suspension or separation agreement containing confidentiality provision is, in fact, subject to public disclosure.
Accrued legal fees for the numerous attorneys for the harassment, PD restructuring and severance package issues alone exceed $40,000 for just three of the five or six attorneys hired by the Town. Legal settlements could run into the millions. As a Town Council member I have repeatedly asked for meetings to discuss litigation costs, which attorney is representing which entity, and which Town insurance companies are presently involved in litigation. I have been refused. The Town Council majority has also refused my request for information.
This week Council member Barbara Moore sent out communications to the public stating that we really should look at all town department budgets for more cuts and that very soon we'll start budget meetings. Are these yet more distractions so the citizens will forget the Town Council majority's illegal and unethical actions?
As I have stated publicly, this pay off is outrageous. Not one penny should be given to Mr. O'Keefe. Contrary to the town attorney's opinion, there absolutely are multiple reasons to terminate for cause. Even without being convicted for sexual harassment claims, lying on his application alone is just cause. Saying I'm a 38 cent problem is just cause. Bragging that they can just distract everyone with a facilities implementation plan alone is just cause. Failing to comply with FOI requirements is just cause.
